Disclosure and Consent — Rent to Own and Rewards

This Consumer Rent Reporting Disclosure, Consent & Privacy Notice (“Notice”) applies to consumers who enroll in or use Rented123.com™ rent reporting, credit-building, identity verification, Open Banking connectivity, financial wellness, RentResume™, Rent-to-Own Points or related services.
For purposes of this Notice, “Rented123,” “Rented123.com,” “we,” “us” or “our” means Rented123.com and the applicable operating entity, including 1113369 B.C. LTD. where applicable. By enrolling in or using a service that requires consent under applicable law, the consumer acknowledges that they have been provided with information concerning the collection, use and disclosure of their information and, where required, expressly authorizes the applicable activities described below.
1. Information We May Collect
Depending upon the services selected, Rented123 may collect, receive, verify, process and maintain information including:
- name and contact information;
- date of birth and other identity information;
- government-issued identification where required for identity verification;
- tenancy and rental information;
- landlord and property-management information;
- rental payment amounts and payment dates;
- payment status and rental-payment history;
- tenancy start and end dates;
- outstanding rental balances where applicable;
- information necessary to establish and maintain a RentResume™;
- bank-account and transaction information where the consumer authorizes Open Banking or financial-data connectivity;
- income and affordability information where separately authorized;
- credit-reporting information where legally permitted;
- device, authentication, security and fraud-prevention information;
- information supplied by landlords, property managers, payment processors, financial institutions, data aggregators and authorized service providers; and
- information necessary to provide, secure and administer Rented123 services.
Rented123 will seek to limit collection to information reasonably necessary for the identified purposes and applicable services.
2. Consumer Consent and Authorization
The consumer authorizes Rented123 and, where applicable and lawfully permitted, its participating landlords, property managers, housing providers, payment processors, financial institutions, data aggregators, credit-reporting agencies, identity-verification providers and other authorized service providers to collect, receive, verify, use, store, process and disclose information necessary to provide the services selected by the consumer. These purposes may include:
- rental-payment reporting and credit-building;
- verification of rental history;
- creation and maintenance of RentResume™;
- identity verification;
- fraud prevention and security;
- authentication and account protection;
- tenant and affordability assessments;
- consumer-authorized financial analysis;
- mortgage-readiness and financial-wellness services;
- administration of Rented123 membership benefits and rewards;
- administration of Rent-to-Own Points;
- compliance with legal and regulatory requirements; and
- operation, maintenance and security of the Rented123 platform.
Where a particular collection, use or disclosure is optional or not necessary to provide the requested service, Rented123 will provide the applicable choice or separate authorization where required by law.
3. Open Banking and Financial Data
Where the consumer separately elects to connect a financial account, the consumer authorizes Rented123 and its authorized technology providers to access and process permitted financial information through applicable Open Banking, banking-data aggregation, account-connectivity, income-verification or similar technologies. Depending upon the service selected, this information may be used to:
- identify and verify rental payments;
- confirm payment amounts and payment dates;
- verify income or affordability;
- provide financial insights;
- identify qualifying rental activity;
- support credit-building services;
- detect potentially fraudulent activity; and
- provide other consumer-authorized services.
The consumer should review the applicable financial-data provider's disclosures and permissions before establishing a connection.
Consumers may withdraw an Open Banking connection where the applicable technology permits withdrawal. Withdrawal may prevent Rented123 from providing services that depend upon that information.
4. Rent Reporting
Where the consumer enrolls in rent reporting, eligible rental-payment information may be reported to applicable consumer reporting agencies, credit bureaus or other authorized reporting systems. Information may include, where applicable:
- rental-payment history;
- payment status;
- account status;
- payment amounts;
- tenancy dates;
- outstanding balances;
- delinquency information; and
- account-performance information.
Rented123 does not guarantee that every rental payment, tenancy, property or consumer will qualify for reporting. Reporting may be subject to the requirements of the applicable reporting agency, data provider, landlord, property manager, payment system and applicable law.
5. Important Rent-Reporting Compliance Requirement
Rented123 makes reasonable efforts to remind and contact members when information necessary to verify and report rental payments is missing, unavailable, disconnected or cannot be verified. The member is responsible for maintaining required information and authorized connections necessary for the applicable service.
If eligible rental-payment information is not received, cannot be verified, or is unavailable to Rented123 for the applicable reporting period, Rented123 may be unable to report a qualifying payment and may report NO ELIGIBLE RENTAL PAYMENT DATA AVAILABLE FOR REPORTING for that period where required or permitted by the applicable reporting system.
This does not necessarily mean that the consumer did not make a rental payment. It means that Rented123 did not have sufficient eligible and verifiable information available for reporting.
Failure to maintain required reporting compliance may result in suspension or cancellation of the applicable membership or service, subject to applicable law and the Membership Terms.
6. Credit Reporting Disclosure
Rented123 does not control consumer reporting agencies or the calculation of consumer credit scores. Participation in rent reporting does not guarantee:
- an increase in a credit score;
- a particular credit score;
- mortgage approval;
- financing approval;
- a particular interest rate;
- future tenancy approval;
- approval for a particular property; or
- any particular financial outcome.
7. Consumer Disputes and Accuracy
Consumers should promptly notify Rented123 of information they believe is inaccurate, incomplete or unauthorized. Consumers may report:
- inaccurate rental-payment information;
- incorrect tenancy information;
- identity theft;
- fraud;
- unauthorized account activity;
- incorrect balances;
- incorrect payment dates; or
- other potentially inaccurate reported information.
Where applicable law requires Rented123 to investigate a dispute concerning information it furnished, Rented123 will follow the applicable dispute-investigation requirements. Rented123 may review relevant records and may request information necessary to investigate the dispute. Where an investigation determines that furnished information is inaccurate or incomplete, Rented123 will take corrective action as required by applicable law.
8. FCRA and Canadian Credit-Reporting Compliance
For U.S. consumers and activities subject to U.S. law, Rented123 will comply with applicable requirements of the Fair Credit Reporting Act (“FCRA”) and applicable implementing rules when acting as a furnisher or otherwise subject to the FCRA.
For Canadian consumers, Rented123 will comply with applicable Canadian privacy and consumer-reporting requirements. Nothing in this Notice limits a consumer's rights under applicable federal, provincial, state or other law.
9. Privacy and Cross-Border Processing
Personal information may be stored, processed or transferred through secure technology systems located in Canada, the United States or other jurisdictions where lawfully permitted. Rented123 may use:
- encrypted cloud infrastructure;
- secure APIs;
- access controls;
- authentication technologies;
- financial-data connectivity providers;
- identity-verification providers;
- payment processors;
- credit-reporting agencies;
- fraud-prevention providers; and
- other authorized service providers.
Rented123 maintains administrative, technical and physical safeguards appropriate to the nature of information handled.
10. Canadian Privacy
Where applicable, Rented123's handling of personal information is subject to Canadian privacy legislation, including the British Columbia Personal Information Protection Act (“PIPA”) and the federal Personal Information Protection and Electronic Documents Act (“PIPEDA”) where applicable. Rented123 will identify the purposes for which personal information is collected, used and disclosed and will obtain the form of consent required by applicable law.
11. U.S. Privacy
For U.S. consumers, Rented123 will comply with applicable federal and state privacy, consumer-protection, data-security and credit-reporting requirements applicable to the services and jurisdiction concerned. Additional state-specific rights, notices or disclosures may apply depending upon the consumer's state of residence.
12. Electronic Communications
Where legally permitted, consumers consent to receive service-related notices, disclosures, authorizations, reporting communications, dispute communications and other documents electronically. Electronic signatures, electronic acknowledgements and electronic records may be used for enrollment, identity verification, reporting authorization and service administration. Consumers may be required to maintain a valid email address or other electronic contact method for service communications.
13. Withdrawal of Consent
Where applicable law provides a right to withdraw consent, the consumer may withdraw consent subject to legal or contractual limitations. Withdrawal of consent may prevent Rented123 from providing services that depend upon the information or authorization withdrawn. Withdrawal does not necessarily require Rented123 to delete information that it is legally required or permitted to retain.
14. No Credit Repair or Professional Advice
Rented123 is an Intelligent Rental Services Technology, Credit-Building Rewards Platform. Unless expressly provided through a properly licensed professional relationship, Rented123 does not provide legal, tax, investment, mortgage-underwriting, financial-planning or credit-repair advice. Consumers should obtain independent professional advice where appropriate.
15. Contact and Privacy Requests
Consumers may contact Rented123 through the privacy, customer-service or dispute channels identified on Rented123.com to:
- request access to applicable personal information;
- request correction of inaccurate information;
- submit a reporting dispute;
- ask privacy-related questions;
- withdraw an applicable consent; or
- report suspected unauthorized access or fraud.
Additional rights and procedures may apply depending upon the consumer's jurisdiction.
